The hearing on the writ filed against the government's decision to dissolve the House of Representatives (HoR) continued today at the Constitutional Bench of Supreme Court.
Lawyers representing the writ petitioners have completed their arguments as of yesterday and the defendant (government) side lawyers have begun pleading in favour of the dissolution from today.
In his arguments, Attorney General Ramesh Badal today claimed that the HoR dissolution was in line with the Constitution and the move was a compulsion for the Prime Minister. He added that the dissolution was for a fresh public mandate and the PM had the right to do so.
Badal argued that the dissolution was a compulsion as the President rejected the claim of KP Sharma Oli and Sher Bahadur Deuba for appointment to the post of the Prime Minister. If the House was not dissolved, PM Oli, as per Article 76 (3) will be continued for an uncertain time, Badal said.
He also argued that the parliamentarians should follow the party rule in a parliamentary system. The hearing will continue on Tuesday as well.
