Informing that the Election Commission does not have the right to trample on Article 38 (4) of the Constitution of Nepal, Dr. Arju Rana Deuba requested the Election Commission to correct their decision regarding candidature.

In the instruction given by the Election Commission to the political parties on April 7 to make the election gender inclusive, the political parties had given priority to women in the nomination of candidates for the post of local level chief and deputy chief or chairperson and vice-chairperson. However, Dr. Deuba, a central member of the Nepali Congress, urged the Election Commission to rectify the provision, saying that the provision of this directive is contrary to Article 38 (4) of the Constitution of Nepal.

Article 38 (4) of the Constitution of Nepal 2015 states that women have the right to participate in all state bodies on the basis of the principle of proportional inclusion. Stating that the latest directive of the Election Commission does not represent the spirit of the constitution, Dr. Deuba appealed to the Election Commission to arrange for the candidature of women on the basis of the principle of correct proportional inclusion.

Dr. Deuba wrote on social media, "I would like to inform the Election Commission that the Election Commission does not have the right to trample on Article 38 (4) of the Constitution of Nepal. I heartily request the Chief Election Commissioner and other members of the Election Commission to correct this decision."
