Prime Minister Pushpa Kamal Dahal 'Prachanda' has furnished a written response to the Supreme Court (SC) on Thursday requesting the SC to scrap the writ petition filed against him on his expressions regarding the deaths that happened in the decade-long insurgency.
In his 13-point written response sent to the SC through the Office of the Attorney General on Thursday, PM Dahal has stated that the petition should be scrapped since it has no constitutional ground and reason.
The PM has stated that his statement was an exercise of fundamental rights of freedom of speech and expression guaranteed by the Article 17 (2) of the Constitution of Nepal and all citizens could exercise the right in an equal manner.
According to PM Dahal, taking responsibility for all deaths taken place in the time of conflict by the rebel side is against the spirit of the comprehensive peace accord and the Constitution of Nepal.
The PM said that his statement on the issue was solely political expression and it should be considered as an expression beyond judicial process.
Furthermore, the PM has said that he was committed to addressing the issues of war-era cases through timely amendment to the Truth and Reconciliation Commission Act and Commission of Investigation on Enforced Disappeared Persons Act.
