During a press meet organised today, Prime Minister KP Sharma Oli stated that nobody could question the rights bestowed on the president. He also mentioned that no complaint could be registered in any office against the president’s right to exercise her authority to implement Article 76 (5) of the Constitution of Nepal.

PM Oli further stated that implementing Article 76 (5) was the sole prerogative of President Bidhya Devi Bhandari and nobody could speak against her right to exercise that authority.

He mentioned that this was the only area where the Constitution provides the president the right to exercise his/her sole prerogative to make a decision. So, nobody can speak against it and a complaint against that move cannot be registered anywhere, PM Oli reiterated.

President Bhandari had implemented Article 76 (5) on May 20 and called on the members of the House of Representatives to claim the premiership by furnishing sufficient grounds to win the vote of confidence in the Parliament. The deadline to do so was 5 pm on May 21.

Nepali Congress President Sher Bahadur Deuba and PM Oli, who is also the chairperson of CPN UML, had submitted their claims to form a new government within the stipulated deadline. However, President Bhandari had rejected both the claims on May 21 itself citing that both the claims did not hold sufficient ground to confirm that they would win the vote of confidence in the Parliament to be appointed the prime minister.
